Molly Mills Creative LLC Terms of Service
Effective Date: March 9, 2026
1. Agreement to Terms
By accessing services from Molly Mills Creative LLC, clients agree to be bound by these terms or cannot use the services.
2. Services
The company provides creative services outlined in individual project proposals, contracts, or statements of work with scope, deliverables, timeline, and fees specified separately.
3. Payment Terms
A non-refundable deposit of 50% is due before work begins. The remaining balance is due upon project completion. Invoices are payable within 15 days. Late payments incur 1.5% per month on the outstanding balance. The company may pause work on projects with unpaid balances.
4. Intellectual Property
Upon full payment, clients receive a license for final deliverables for their intended purpose. The company retains ownership of preliminary work, drafts, concepts, and unused designs, and may display completed work in portfolios unless a confidentiality agreement exists.
5. Revisions and Approvals
Projects include defined revision rounds per the agreement. Additional revisions are billed at the Company's standard hourly rate. Client approval constitutes acceptance of work completed to that point.
6. Client Responsibilities
Clients must provide necessary content, materials, feedback, and approvals timely. Client-caused delays may result in adjusted timelines and additional fees. Clients represent that provided materials don't infringe third-party rights.
7. Cancellation and Termination
Either party may terminate with written notice. Clients canceling after work begins owe payment for completed work including the non-refundable deposit. The company may terminate for client breach, with all amounts immediately due.
8. Limitation of Liability
The company's liability shall not exceed the total fees paid by the Client for the specific project in question. The company isn't liable for indirect, incidental, or consequential damages including lost profits.
9. Indemnification
Clients indemnify the company and its members, employees, and contractors from claims, damages, or expenses arising from deliverable use or terms breaches.
10. Confidentiality
Both parties keep proprietary or sensitive information confidential, with this obligation surviving engagement termination.
11. Force Majeure
Neither party is liable for delays or performance failures from causes beyond reasonable control, including natural disasters, government actions, or infrastructure failures.
12. Governing Law
These terms are governed by Texas law. Disputes are resolved in Travis County, Texas courts.
13. Modifications
The company may update terms anytime. Continued service use constitutes acceptance of revisions. Material changes are communicated to active clients in writing.
14. Entire Agreement
These terms and project-specific agreements constitute the complete agreement and supersede all prior communications, oral or written.
